2 types of cases that can stem from a car crash

When car crashes occur, occupants of the vehicles can suffer from injuries. These cases can lead to a personal injury claim that enables the victim to seek compensation for the financial damages they’re dealing with. 

The compensation claim is filed in civil court. Civil cases can result in monetary compensation, but they don’t involve penalties like imprisonment. In order for a civil case to be successful, the complainant has to prove their side based on the preponderance of evidence. 

1. Criminal cases are sometimes possible

It’s sometimes possible that the person who caused the crash may also have criminal charges levied against them. The prosecutor must prove the criminal charges beyond a reasonable doubt in order for the person to be convicted. This is a stricter standard than what’s required for a civil case.

Some people think that the concept of double jeopardy applies to these cases, but they’re incorrect. Because these cases are heard in different types of court, it’s possible for the person to have to face both. 

2. Cases are independent

The criminal case and the civil case are fully independent of each other. This means that a person can be found liable in civil cases but found not guilty in the criminal case. The opposite is also true. 

These cases can be complex, so it’s critical that individuals who are parties in them should seek the assistance of someone who’s familiar with these matters. This can help them to protect their rights and present their side.
